Title IX

American Medical Academy

Title IX of the Education Amendments of 1972 (“Title IX”), 20 U.S.C. §1681 et seq., is a Federal civil rights law that prohibits discrimination on the basis of sex in education programs and activities. All schools regarding whether private, public, degree or non/degree receiving any Federal funds must comply with Title IX. Title IX, must be followed without any discrimination on the basis of sex can include sexual harassment or sexual violence, such as:  Rape, sexual assault, sexual battery, and sexual coercion.

Under Title IX it protects any person discriminating, regardless their sex-based, real or perceived sex, gender identity, and/or gender expression. Female, male, and gender non-conforming students, faculty, and staff are protected from sex-based discrimination, harassment or violence. Any form of Sexual Harassment may it be verbal, non-verbal, or physical in nature and prohibited by Title IX.

Any employee, student, applicant for employment, or applicant for admission who believes that he/she/they has been harassed or retaliated against in violation of this policy should immediately report such incidents by following the procedures described in AMA’s Title IX procedure. AMA requires supervisors to report all incidents of harassment and retaliation that come to their attention.

American Medical Academy (AMA) is committed to ensure all students, faculty and staff at our institution attend/work in an environment that is free of sex discrimination responding promptly and effectively. Information and orientation on Title IX is provided to all incoming new students during their orientation day, which is on or before the first day of school, and informed how to contact AMA’s Title IX Coordinator. Throughout the facilities you will find informational posting regarding Title IX.

In order to file a complaint with AMA, please complete and bring the “AMA Complaint Form” in person to the Title IX Investigator.  If you are unable for any reason to complete this form and would like to make a verbal complaint, please call AMA’s Title IX Investigator:

AMA is committed to providing access to Title IX-related resources, both to students and employees.

Overview

In compliance with the 2020 Title IX Regulations, AMA must provide information about and access to training materials used to training those involved in the Title IX Resolution Procedures (e.g., Title IX Coordinators, investigators, decision-makers, and any person who facilitates and informal resolution process). Please be advised that the materials below reflect the mandatory reporting requirement effect August 14, 2020, and do not reflect all training received previously or training the individuals may receive for other aspects of their professional roles outside of required knowledge and skills for conducting Title IX Resolution Procedures. The Title IX regulations require that individuals receive training about:
  • The definition of sexual harassment
  • The scope of AMA’s education program or activity
  • How to conduct an investigation and grievance process, including hearings, appeals and informal resolution procedures
  • How to serve impartially, including by avoiding any prejudgment of the facts at issue, conflicts of interest, and bias
  • Decision-makers must also receive training on any technology to be used at a live hearing and on issues of relevance and evidence, including when questions and evidence about the complainant’s sexual predisposition or prior sexual behavior are not relevant
  • Investigators must also receive training on issues of relevance to create an investigative report that fairly summarizes relevant evidence

In addition, those individuals involved in the resolution proceedings related to sex crimes of sexual assault, dating violence, domestic violence and stalking, must also receive annual training on issues related to these crimes and how to conduct an investigation and hearing process that protects the safety of the victims and promotes accountability.

Hernandez, AS, PMD, Campus EMS Administrator is the coordinator of Title IX, the Education Amendments Act of 1972, which prohibits discrimination based on sex in any education program or activity receiving federal financial assistance. All inquiries or complaints under the sex discrimination provision of Title IX should be directed to Antonio J. Hernandez, AS, PMD, Title IX Coordinator. The title IX coordinator must act equitably and promptly to resolve complaints and should provide a response within seven (7) working days.
